Welcome to the Wonder Call website.

Whilst we probably dislike this legal stuff just as much as you do, it is important to establish a few terms and conditions under which you visit and use the Website and purchase our goods and services, we also need to grant you a licence to download our intellectual property, but we will try to make it as plain, simple, and painless as we can.

In these Terms of Use

intellectual property means patents, copyright, trademarks, service marks, trade, business and domain names, rights in trade dress or get-up, rights in goodwill, unfair competition rights, rights in designs, rights in computer software, database rights, topography rights, moral rights, rights in confidential information (including know-how and trade secrets), rights to inventions and utility models, rights to sue; in the design, images, graphics, text, source code, scripts and software

'Website' (when used with a capitalised initial letter) refers to www.wondercalls.co.uk

'we', 'us', or 'our' refers to INNOVATION 13 LIMITED. A company incorporated in England with its registered office at 86-90 Paul Street, London, EC2A 4NE and a company registration number of 16606645.

'Wonder Calls' are AI generated telephone calls in the voice of a selected character to a designated telephone number provided, for the duration of 1 or more tokens as specified on the Website.

'you' or 'your' refers to you, the visitor to the Website.

Terms and Conditions

1) These Terms of Use govern the use of the Website.
2) If you do not accept or disagree with any part of these Terms of Use then you must not use this Website, if you do use the Website then you will be deemed to have accepted the Terms of Use.
3) If you purchase tokens for a Wonder Call then you will be required to expressly agree to the Terms of Use at the checkout.
4) Viewing the Website does not create any obligation upon you to use any services or purchase any tokens, nor upon us to provide any services. In legal terms, the advertising of services on the Website constitutes an 'invitation to treat' not a contractual offer.
5) We take care to show the content as accurately as possible, however colours, shapes, layout, design, images etc can be distorted during the downloading, reproduction, or reconstruction of the Website by the device you use, also individual manufacturer or personal user settings of your device may affect how the Website is displayed, we cannot guarantee the colour, shade, shape, size, or any other visual aspect is an exact match with anything displayed on the Website.
6) If you wish to purchase tokens and book a Wonder Call you will need to create an account. You must be over the age of 18 to create an account.
7) To create an account, you will need to register with a user name and password. It is your sole responsibility to ensure all information submitted when creating an account is true, accurate and error free
8) Registered users are solely responsible for the safety and security of the username and password, and accept sole responsibility for any unauthorised access as a result of any loss, disclosure, or failure to keep the access information secret. It is recommended that passwords are changed on a regular basis and report to us any activity which you know or suspect of being as a result of unauthorised access.
9) Registered users must not use their account to
  • a) do anything that would be unlawful or not permitted within the Website Terms of Use or licence to use our intellectual property;
  • b) impersonate any person or entity;
  • c) make any false statements or misrepresentations (including during the registration process);
  • d) infringe upon any patent, trademark, trade secret, copyright, right of privacy or other proprietary rights of any party;
  • e) acquire or attempt to acquire any details of any other registered user;
  • f) harass, bully or cause distress to another user of the Website or any of our employees;
  • g) access or attempt to access another user's account.
10) Registered users can purchase tokens to be exchanged for Wonder Calls.
11) The cost and duration of a token is as stated on the Website.
12) Registered users can book Wonder Calls through their account. A Wonder Call is to a child (a person under the age of 18) can only be booked by a person who is over the age of 18. By booking a Wonder Call for a child, you confirm that you are the parent or legal guardian of the child receiving the Wonder Call, or you have the consent of the parent or legal guardian.
13) Tokens are not refundable as Wonder Calls are personalised and the right to cancel in The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply however
  • a) You can cancel and reschedule a booked Wonder Call at anytime up to 15 minutes before the scheduled time.
  • b) If a Wonder Call does not occur at the scheduled time for any reason, including (but not limited to) the call is not answered, or an error on our part whether technical or otherwise, you will need to reschedule the call in your account.
  • c) Unused tokens can be used at any rescheduled time or for a different character than was originally booked.
14) The Wonder Call will be recorded in a wav/mp3 format and the recording will be available to view from your account whilst ever the account is open. You will be provided with a link so you can share the recording with family and friends if you wish. You are fully responsible for the use of the recording through the link and will have the option in your account to keep the recording private.
15) We retain the right to remove any recording if the service is used to generate offensive or inappropriate content or the account is inactive for more then 12 months.
16) Personal Data is collected, processed, stored, and retained in accordance with our Privacy Notice available on the Website.
17) All intellectual property in the Website content, design, images, graphics, text, layout, software, source code, and Wonder Call recordings is owned by or licenced to us and is protected under UK laws and worldwide treaties.
18) Any Trademarks within this Website which are not the property of, or licenced to us are recognised, acknowledged, and respected.
19) We grant to you a conditional, royalty free, non-exclusive, non-transferable, licence to download, view, and print pages from this Website, and view or share the Wonder Call recordings.
20) In return for granting you this licence you agree not to do any of the following, or not allow to be done, to any material from the Website or the Wonder Call recordings without our express written consent:
  • a) republish, redistribute, reproduce, duplicate, copy, translate, transmit, broadcast, sell, rent, sub-licence;
  • b) use, publish, copy, frame or embed on other websites, apps, or any other distributable media;
  • c) use for a commercial purpose;
  • d) attempt to edit, modify, amend, disassemble, decompile;
  • e) conduct any data collection (whether automated or not) including but not limited to data scraping, data mining, data extracting and data harvesting:
  • f) use or access the Website in any way that causes, or may cause, damage to the Website or its hosting servers or networks;
  • g) use or access the Website in any way that impairs or interferes with of the availability or accessibility of the Website;
  • h) use or access the Website in any way that is unlawful, illegal, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or for a harmful purpose or activity;
  • i) disrupt the normal flow of data in a manner that negatively affects or otherwise diminishes the quality of another user's experience of this Website;
  • j) upload, transmit or link to software viruses or any other malicious computer code, files or programs designed to interrupt, destroy, or limit the functionality of any computer, device, software or hardware or telecommunications equipment.
21) The description, prices, offers, specifications and availability of goods and services is subject to change without notice and provided without warranty that they are accurate or error free.
22) We may revise, amend or update these Terms of Use from time to time for things like introducing new products, services or website content; increasing the Website's functionality, keeping up with advances in technology or reflect changes to applicable regulations, any changes will apply to the use of the Website from the date of publication and you should check this page regularly to ensure that you are familiar with and accept the current version.
23) The Website may include advertisements or links to other websites and are provided for convenience and information only. Links and advertisements are not intended to be, and shall not be taken as an endorsement or recommendation of any website or goods advertised unless expressly stated.
24) We operate a zero tolerance policy for any misuse or breach of these Terms of Use in the interest of keeping our visitors safe and for detecting misuse we may use any method available, including technical and legal to prevent or remedy a breach of these Terms of Use and the licence. Unauthorised use or misuse of the Website may give rise to a claim for damages or be a criminal offence.
25) We may recover any costs, expenses or losses incurred as a result of any misuse or abuse of the Website or networks including but not limited to costs incurred for repairing or cleaning the Website, loss of income, disruption to our business, legal fees, and the use of third party specialists.
26) We shall have no liability to you in relation to your use of the Website whether under law, regulation, contract, tort (including negligence), warranty or otherwise; for any loss or damage of any nature, irrespective of the basis behind a claim to the extent that:
  • a) your access to the Website is provided free-of-charge (notwithstanding that your connection to the internet is subject to fees from your internet service provider) and if you are dissatisfied with any aspect of the Website then your sole and exclusive remedy is the discontinuation of your use of the Website;
  • b) we will make all reasonable endeavours to maintain continuous access to the Website, however availability may be interrupted as a result of routine, periodic or necessary, maintenance and repairs; updates and upgrades to the underlying software and equipment used to make the Website accessible via the internet; maintaining security; and keeping up with technological advances;
  • c) technology and equipment can function incorrectly or fail to function at all, the operation and availability of the Website or the flow of data may be interrupted, interfered with, damaged, or become corrupt beyond our reasonable control;
  • d) the transmission of data through the internet is inherently insecure, we will use every reasonable endeavour to ensure the integrity and security of the Website and equipment but cannot guarantee that the Website has not been accessed or interfered with by a third party or malicious software or that the data you receive or send has not been misrouted. You should provide your own security software on the device you use the access the Website and the compatibility, effectiveness and updating of that software is your sole responsibility;
  • e) access to the Website may also be limited, restricted, or denied as a result of a Force Majeure event (beyond our reasonable control), including but not limited to adverse weather, war, terrorism, strikes, fires, floods, pandemics, epidemics, governmental restrictions, power or network failures, failure of suppliers, sub-contractors, or carriers;
  • f) we do not know the software or apps that are installed on the device you use to access the Website and we are not able to guarantee that the Website is compatible with any third party scripts, code, software, or apps that you upload or install on your device.
27) Our liability to you in respect of purchasing tokens or performing Wonder Calls shall not exceed the cost of the tokens.
28) Nothing in these Terms of Use (or elsewhere on the Website) will exclude or limit our liability for fraud, or for death or personal injury caused by our negligence.
29) A person who is not party to these Terms of Use shall not have any rights, benefits, or obligations under the Contract (Rights of Third Parties) Act 1999 except for an insurers right of recourse where one exists.
30) If any provision of these Terms of Use is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
31) No forbearance or delay in enforcing these Terms of Use or any other legal right shall prejudice, restrict, interfere, or otherwise diversely affect the right to enforce those Terms at a later time or for a subsequent breach.
32) These Terms of Use are constructed and governed in accordance with English Law and only available in the English language, the courts of England and Wales have exclusive jurisdiction to adjudicate and provide determinations on any dispute arising from or in relation to them.
